International Court of Justice ruling demands government action
Last week’s decision of the International Court of Justice that Israeli settlements on Palestinian land are illegal demands immediate action from our government.
The ICJ found that "Israeli settlements in the West Bank and East Jerusalem, and the regime associated with them, have been established and are being maintained in violation of international law"
The Court went on to say that the UN Security Council, the General Assembly and all states have an obligation not to recognise the occupation as legal and not to give aid or support toward maintaining it.
In response our government should immediately:
impose a ban on the importation of all products from the illegal Israeli settlements and
direct our Superfund, ACC and Kiwisaver funds to divest from companies identified by the United Nations Human Rights Council as complicit in the building and maintenance of these settlements. The recently updated database is here in a pdf.
Friday’s ICJ ruling confirms what the United National Security Council found in passing resolution 2334 in 2016.
This resolution was co-sponsored by New Zealand (New Zealand had a place on the Security Council at the time under a National-led government)
The United Nations Security Council stated that, in the occupied Palestinian territories, Israeli settlements had “no legal validity” and constituted “a flagrant violation under international law”. It said they were a “major obstacle to the achievement of the two-state solution and a just, lasting and comprehensive peace” in the Middle East.
Friday’s ICJ ruling reinforces the UN resolution and the need for government action.
“New Zealand, which co-sponsored the UN resolution in 2016 should lead the way on this” says PSNA National Chair John Minto. “We need to put our money where our mouth is – especially since the current far-right Israeli government has said its “top priority” is to push ahead with more illegal Israeli settlements on occupied Palestinian land”

After 10 months of doing nothing to prevent genocide, which the government is required to do under the Genocide Convention, this is all the government has had to say…
For decades, successive New Zealand governments have been making these pious statements about international law knowing full well that Israel will ignore them with absolute impunity. This is wilful abuse of international law by New Zealand – it is racist complicity with genocide, ethnic cleansing, theft of land, apartheid and Israels’ myriad war crimes.

“Educators for Palestine”, seeking your help
“Educators for Palestine”, standing together for the right of young Palestinians to life and education, are asking for PSNA supporters and groups around the motu to not only sign this open letter but to promote it at rallies and events.
We are keen that at the nationwide events supporters are encouraged to ask the vast and varied kinds of educators in our whanau, communities and associated organisations to go on line and sign this Open Letter, as Educators are everywhere. (Below read more about Educators for Palestine along with the state of education under bombardment in Gaza which has been described as being ’scholastacide.’).

The open letter says:
We, the undersigned educators, call on the New Zealand government to:
Use diplomatic means to push for an immediate and permanent ceasefire and an end to the 17-year blockade of Gaza.
Increase funding and support to agencies which run schools in Gaza, including but not limited to UNRWA (UN Relief and Works Agency), which runs 40% of Gaza’s schools.
Condemn the deliberate and targeted bombing of schools and education infrastructure in Gaza as an attack on Palestinian children and society.
Ceres Organics on the wrong side of Tahini
A Palestine solidarity supporter questioned why the well-known organics company Ceres would sell tahini made in Israel in defiance of calls from Palestinians for BDS (Boycott Divestment and Sanctions) against Israel.
Ceres response included a letter from the Israeli supplier of tahini which stated that their company employs both Israeli and Palestinian workers and that any boycott would just hurt the workers (this was a favourite response from white South African companies trying to avoid sanctions of apartheid South Africa)
However, after a bit more investigation our supporter wrote back to Ceres:
I investigated your supplier further and can see that you have been misled about their ethics. This company operates in the Occupied Palestinian Territories, so on land illegally stolen from Palestinians.
The company’s main production and logistics facilities are located in Ariel IZ, a settlement industrial zone in the occupied West Bank. Ariel West IZ is located on the lands of the Palestinian village of Salfit.
In addition the company is an authorized supplier of the Israeli military. In 2019, the Israeli Ministry of Defense purchased 21 tons of sweet from the company for Israeli soldiers.
I would also like to point out that tahini is not an Israeli food and for them to market it as such is dishonest and amounts to cultural misappropriation.
So again I request that you find an alternative source of tahini. It would be particularly appropriate if you were able to source tahini from an authentic Palestinian source (made by the Palestinian diaspora since Palestinian products are blocked from markets).

Stocking tahini from a company on stolen Palestinian land which supplies the Israeli military and pays taxes to Israel is not a good look for Ceres and undermines their statements about ethics

Quit Obela Hummus in August – some background
August is the month to drive Obela food products off the shelves of supermarkets in Aotearoa.
Obela is Israel’s second largest food company. It is proud of supporting the Israeli military. The company describes itself as ‘born of a Zionist Vision’ and ‘having ‘roots imbedded in the founding of the State of Israel.’
In practice, this meant the Obela food chain was established on land stolen from Palestinians when they were expelled from Palestine in 1948.
Obela processes food in Australia, in particular hummus, and sells it in our supermarkets.
The international Boycott, Sanctions and Divestment campaign has long had Obela on its list of Israeli connected products to avoid, to bring economic and social pressure on Israel to allow Palestinian rights and comply with international law.
We urgently need to increase the pressure on Israeli investments in Aotearoa – commercial, cultural, academic and government.
Its time to gear up the campaign. Our government is silent in its indifference to rules based international law.
Instead of just avoiding buying Obela, we can make sure our supermarkets stop selling it. They will, but only if there is enough protest action in enough supermarkets, around the country, and often enough.
How you go about achieving this, is up to you. But any action which makes it not worthwhile for a supermarket to continue to sell Obela, is an action in support of Palestine’s struggle for freedom.

“THE HAGUE, 19 July 2024. The International Court of Justice has today given its Advisory Opinion in respect of the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem. It is recalled that, on 30 December 2022, the General Assembly of the United Nations adopted resolution A/RES/77/247 in which, referring to Article 65 of the Statute of the Court, it requested the International Court of Justice to give an advisory opinion on the following questions:
“(a) What are the legal consequences arising from the ongoing violation by Israel of the right of the Palestinian people to self-determination, from its prolonged occupation, settlement and annexation of the Palestinian territory occupied since 1967, including measures aimed at altering the demographic composition, character and status of the Holy City of Jerusalem, and from its adoption of related discriminatory legislation and measures?
(b) How do the policies and practices of Israel referred to . . . above affect the legal status of the occupation, and what are the legal consequences that arise for all States and the United Nations from this status?”
In its Advisory Opinion, the Court responds to the questions posed by the General Assembly by concluding that:
the State of Israel’s continued presence in the Occupied Palestinian Territory is unlawful;
the State of Israel is under an obligation to bring to an end its unlawful presence in the Occupied Palestinian Territory as rapidly as possible;
the State of Israel is under an obligation to cease immediately all new settlement activities, and to evacuate all settlers from the Occupied Palestinian Territory;
the State of Israel has the obligation to make reparation for the damage caused to all the natural or legal persons concerned in the Occupied Palestinian Territory
all States are under an obligation not to recognize as legal the situation arising from the unlawful presence of the State of Israel in the Occupied Palestinian Territory and not to render aid or assistance in maintaining the situation created by the continued presence of the State of Israel in the Occupied Palestinian Territory;
international organizations, including the United Nations, are under an obligation not to recognize as legal the situation arising from the unlawful presence of the State of Israel in the Occupied Palestinian Territory; and
the United Nations, and especially the General Assembly, which requested the opinion, and the Security Council, should consider the precise modalities and further action required to bring to an end as rapidly as possible the unlawful presence of the State of Israel in the Occupied Palestinian Territory.
Reasoning of the Court… The Court then examines the question of the legal consequences arising from Israel’s adoption of related discriminatory legislation and measures (paras. 180-229). It concludes that a broad array of legislation adopted and measures taken by Israel in its capacity as an occupying Power treat Palestinians differently on grounds specified by international law. The Court notes that this differentiation of treatment cannot be justified with reference to reasonable and objective criteria nor to a legitimate public aim. Accordingly, the Court is of the view that the régime of comprehensive restrictions imposed by Israel on Palestinians in the Occupied Palestinian Territory constitutes systemic discrimination based on, inter alia, race, religion or ethnic origin, in violation of Articles 2, paragraph 1, and 26 of the International Covenant on Civil and Political Rights, Article 2, paragraph 2, of the International Covenant on Economic, Social and Cultural Rights, and Article 2of the International Convention on the Elimination of All Forms of Racial Discrimination.”

“Pitiful in the face of genocide” – yes that’s our government. It still hasn’t even reached first base in responding to the industrial scale slaughter of Palestinians in Gaza. First base would be to condemn Israel and call for an immediate permanent ceasefire.
We need to challenge government MPs in National, New Zealand First and Act.
